1. Agreement to Terms
These Terms and Conditions constitute a legally binding agreement between you, whether personally or on behalf of an entity ("you"), and Glenn Lundy LLC DBA 800 Percent Life ("Company," "we," "us," or "our"), concerning your access to and use of the Morning 5 application, the 800percent.life website, and any related mobile applications, websites, or services (collectively, the "Site").
By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms.
IF YOU DO NOT AGREE WITH THESE TERMS, YOU MUST DISCONTINUE USE IMMEDIATELY.
2. Intellectual Property Rights
Unless otherwise indicated, the Site and all associated content, including but not limited to source code, databases, functionality, software, designs, text, graphics, logos, audio, and video (collectively, the "Content"), are the proprietary property of the Company and are protected by applicable intellectual property laws.
3. User Representations
By using the Site, you represent and warrant that:
- All information you provide is accurate and current
- You have legal capacity to agree to these Terms
- You are not prohibited from using the Site under applicable law
- You will not access the Site through automated means
- You will not use the Site for unlawful purposes
4. Prohibited Activities
You agree not to use the Site for any purpose other than its intended use. Unauthorized commercial use is prohibited unless expressly approved by the Company.
5. Mobile Application License
If you access the Site via a mobile application, we grant you a limited, revocable, non-exclusive, non-transferable license to install and use the application solely for personal, non-commercial use, subject to these Terms.
6. User-Generated Content & Community Standards
The Site permits limited user-generated content ("UGC"), including custom messages sent between users (such as nudges and encouragements) and profile images. By using these features, you agree to abide by the following Community Standards.
Zero-Tolerance Policy
The Company maintains a zero-tolerance policy for objectionable content and abusive users. The following are strictly prohibited:
- Content that is offensive, harassing, bullying, threatening, or abusive
- Sexually explicit, pornographic, or obscene material
- Hate speech, discrimination, or content promoting violence
- Spam, phishing, scams, or misleading content
- Content that violates any applicable law or regulation
- Impersonation or misrepresentation of identity
Content Filtering
All user-generated messages are subject to automated content filtering. Messages containing profanity, slurs, or other objectionable language will be rejected. The Company reserves the right to update filtering criteria at any time.
Reporting Obligations
If you encounter objectionable content or abusive behavior, you are encouraged to report it immediately using the in-app reporting feature. You may report users directly from their profile or from your friend list. Reports can be filed for harassment, inappropriate content, spam, or other violations.
Blocking Users
You may block any user at any time. Blocking a user will immediately remove them from your connections and prevent further interaction. The Company will be notified of all blocks for review.
Moderation & Enforcement
The Company commits to acting on all reports within 24 hours. Enforcement actions may include, but are not limited to:
- Removal of objectionable content
- Issuing warnings to offending users
- Temporary or permanent suspension of accounts
- Banning users who repeatedly violate these standards
The Company reserves the right to remove any content and/or terminate any user's account at its sole discretion, without prior notice, if it determines that a violation of these Community Standards has occurred.
7. SMS/MMS Mobile Messaging Program
We may offer a mobile messaging program that provides:
- Account notifications
- Security alerts
- Service updates
Consent to Receive Messages
By providing your phone number, you expressly consent to receive SMS or MMS messages from Glenn Lundy LLC DBA 800 Percent Life.
You represent that:
- You are the authorized user of the phone number
- You have authority to provide consent
Opt-Out
You may opt out at any time by replying STOP. After opting out, you will receive confirmation of your unsubscribe request.

Carrier Liability Disclaimer
SMS and MMS delivery is subject to effective transmission by your mobile carrier. Carriers are not liable for delayed, undelivered, or misdirected messages.
Privacy Commitment
We respect your privacy. No mobile information, including SMS consent data, will be shared with third parties or affiliates for marketing or promotional purposes.
8. Rewards Program & Points
The Site may include a rewards program that allows you to earn points, badges, streaks, and other virtual incentives through participation in daily activities, referrals, and other engagement features (collectively, the "Rewards Program"). By participating, you agree to the following:
No Monetary Value
Points and virtual rewards have no cash value and do not constitute currency, property, or any form of stored value. Points cannot be purchased, sold, bartered, or transferred to another user or account. Points are not redeemable for cash under any circumstances.
Right to Modify or Discontinue
The Company reserves the right to modify, suspend, or discontinue any aspect of the Rewards Program at any time, without prior notice. This includes, but is not limited to, changing point values, reward offerings, redemption costs, badge criteria, streak calculations, and program rules. No modifications shall entitle you to compensation or vested rights to any accumulated points or rewards.
Reward Availability
Rewards offered through the program are subject to availability and may be limited in quantity, discontinued, substituted, or modified at the Company's sole discretion. The Company does not guarantee that any particular reward will remain available.
Errors & Corrections
The Company is not responsible for errors in point calculations, badge awards, streak tracking, reward fulfillment, or any other aspect of the Rewards Program that may occur due to system errors, software bugs, connectivity issues, data processing delays, or other technical malfunctions. The Company reserves the right to correct any such errors at any time, including adjusting point balances, revoking incorrectly awarded badges, or reversing redemptions, without prior notice or liability.
Physical Reward Fulfillment
For rewards that require physical delivery, you must provide accurate shipping information at the time of redemption. The Company is not responsible for delays, loss, or damage caused during shipping. Delivery times are estimates only and are not guaranteed. Items will be shipped to the address provided at the time of redemption.
Account Forfeiture
All points, badges, streaks, and unredeemed rewards are forfeited upon account deletion or termination, whether initiated by you or by the Company. The Company shall have no obligation to compensate you for forfeited points or rewards.
Anti-Abuse & Fair Use
The Company reserves the right to suspend, revoke, or terminate your access to the Rewards Program, void accumulated points, and revoke badges if the Company determines, in its sole discretion, that you have engaged in fraud, manipulation, abuse, or any conduct that undermines the integrity of the program. This includes, but is not limited to, creating multiple accounts, using automated tools, exploiting referral systems, or any other activity the Company deems inconsistent with the program's intended purpose.
9. Disclaimer of Warranties
THE SITE AND ALL CONTENT, FEATURES, AND SERVICES PROVIDED THROUGH THE SITE, INCLUDING THE REWARDS PROGRAM, ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. THE COMPANY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
The Company does not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components. The Company does not warrant the accuracy, reliability, or completeness of any content, including point balances, streak data, badge awards, or reward availability.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR THE REWARDS PROGRAM, INCLUDING BUT NOT LIMITED TO LOSS OF POINTS, LOSS OF REWARDS, ERRORS IN POINT CALCULATIONS, BADGE REVOCATIONS, OR STREAK RESETS, REGARDLESS OF THE CAUSE OF ACTION OR THEORY OF LIABILITY.
In no event shall the Company's total liability to you for all claims related to the Rewards Program exceed the greater of fifty dollars ($50.00) or the retail value of the specific reward at issue.
11. Governing Law
These Terms shall be governed by the laws of the State of Kentucky, without regard to conflict of law principles.
